WHAT’S ON TAP?

Today on Capitol Hill…

It’s Friday, and there’s been very little movement on the government funding front. The key is the Senate — the House passed a clean CR that funds the government through November 21 and is out until Wednesday. 

And the question is whether Senate Minority Leader Chuck Schumer (D-NY) will stand firm or fold the way he did in March. House Minority Leader Hakeem Jeffries (D-NY) and House Democrats are dug in, but their votes are beside the point at the moment. And, as noted in Thursday’s Morning Musing, I’m rather over it all. (But with the critters out until next week, this is where all the focus remains.) 





White House What’s Up

On Thursday, President Donald Trump met with Turkish President Recep Tayyip Erdoğan. In the afternoon, he signed an executive order regarding TikTok.

On Friday, President Trump heads to Bethpage, New York, to attend the Ryder Cup. He’s due to return to the White House late Friday afternoon. In the meantime, he’s been weighing in on the indictment of former FBI Director James Comey.

There were several court decisions/developments of note on Thursday, including:

  • ❌ Federal Education Association v. Trump (challenging termination of collective bargaining agreements), D.C. Circuit Court of Appeals, in a 2-1 ruling, dissolves prior administrative stay of preliminary injunction entered by district court and DENIES admin’s motion for stay pending appeal. 
  • ✅ Appalachian Voices v. EPA (challenging EPA’s termination of block grants), Judge Richard Leon (D.C.) DENIES plaintiffs’ motion for injunction pending appeal.
  • ↔️ D.C. v. Trump (challenging president’s/AG’s actions re: home rule), plaintiff voluntarily dismisses case without prejudice.





We’re also waiting to see what the Supreme Court does with the application for stay pending before it in the Lisa Cook (removal as Fed governor) case. I won’t be at all surprised if we see a ruling on that sometime today. 

And…of course, the big legal news of the day was, as noted above, the indictment of former FBI Director James Comey on two counts (obstruction and making a false statement).

COMING ATTRACTIONS

As mentioned above, look for a SCOTUS ruling on the Lisa Cook case. I’ve a sneaking suspicion we’ll see that later today. 

And, of course, next week will be all about Shutdown! Shutdown! Shutdown!

MORNING MUSING

At 6’8″, Jim Comey can’t help but be above it all — literally. And throughout his public tenure, he’s carefully curated an air of above-it-allness — one which seemingly worked for a time. But that act wore thin and, in recent months, we’ve been treated to middle school mean girl Jim, who thinks it’s cute to send not-so-vaguely threatening messages via seashell arrangements. 

“No one is above the law” became a popular refrain when then-former President Trump was being prosecuted under novel legal theories and sued compliments of specially reworked statutes of limitations. Indeed, they are not — not even presidents/former presidents, despite a fairly expansive immunity umbrella. 





Nor is Jim Comey, despite his unusual height and his above-it-all air. 

Now, I do agree with him on one thing: Let’s have a trial. Let prosecutors do their thing and prove up their case. Let Comey present a defense. (Wonder who’ll be representing him?) Let fair and impartial jurors decide his fate. He’s due his process (as are all). 

But he’s not above the law.
