Trump Announces Next Steps As Judge Orders USDA Funding, SNAP Deadline Looms on Saturday, Nov. 1 – RedState

President Donald Trump announced the steps he’s taken in order to try and keep Americans from losing SNAP benefits, as the deadline looms with Democrats’ refusal to reopen the government.





In a post on Friday on X, President Trump reacted to two federal judges’ rulings in two different cases about the end of the food benefits program, which run out on November 1. 

As my RedState colleague Susie Moore reported, each of the judges ordered Trump to use U.S. Department of Agriculture (USDA) reserve funds, set aside for emergencies, in order to fund the benefits due to the lapse in appropriations caused by the Democrats.

“Our Government lawyers do not think we have the legal authority to pay SNAP with certain monies we have available, and now two courts have issued conflicting opinions on what we can and cannot do,” Trump wrote. “I do not want Americans to go hungry just because the Radical Democrats refuse to do the right thing and reopen the government.”

“Therefore, I have instructed our lawyers to ask the Court to clarify how we can legally fund SNAP as soon as possible,” he added. “It is already delayed enough due to the Democrats keeping the Government closed through the monthly payment date, and, even if we get immediate guidance, it will unfortunately be delayed while States get the money out.”

“If we are given the appropriate legal direction by the Court, it will be my honor to provide the funding, just like I did with Military and Law Enforcement Pay. The Democrats should quit this charade where they hurt people for their own political reasons, and immediately reopen the government. The court cases President Trump mentioned were highlighted in this RedState piece on Friday. One involved a judge in Rhode Island, District Court Judge John McConnell, who issued his ruling Friday, which basically directed that Trump use emergency reserves because Democrats are playing games with the American people.

The decision read:

In Providence, Rhode Island, U.S. District Judge John J. McConnell ruled from the bench in a case filed by cities and nonprofits that the program must be funded using at least the contingency funds, and he asked for an update on progress by Monday. Along with ordering the federal government to use emergency reserves to backfill SNAP benefits, McConnell ruled that all previous work requirement waivers must continue to be honored. The USDA during the shutdown has terminated existing waivers that exempted work requirements for older adults, veterans and others.

In Massachusetts, District Court Judge Indira Talwan held a hearing on Thursday morning for the state’s motion to force the use of the emergency funds.

Massachusetts, asserting, “on information and belief,” that the U.S. Department of Agriculture (USDA) “has funds available to it that are sufficient to fund all, or at least a substantial portion, of November SNAP benefits.” The states essentially asked the court to rule that the USDA can’t suspend SNAP benefits despite the lapse in appropriations and order the USDA to pay benefits out of its contingency reserve.





Talwan issued an order on Friday that “compels the Trump administration to jump through certain hoops,” Moore noted.

It read:

No later than Monday, November 3, 2025, Defendants shall advise the court whether they will authorize at least reduced SNAP benefits for November and, if so, their timeline for determining whether to authorize only reduced SNAP benefits using the Contingency Funds or to authorize full SNAP benefits using both the Contingency Funds and additional available funds.
