Supreme Court Takes Up Boys in Girls’ Sports

Today the Supreme Court heard arguments in two cases that raise the question whether a state can bar boys from participating in girls’ sports. The answer is obvious: it can, and in fact all states did so, until about 15 minutes ago. Nevertheless, the Court is in a position of having to correct error, since in both of those cases, the Court of Appeals held that states must permit boys in girls’ sports.

SCOTUSBlog recounts the cases’ histories and describes today’s hearing. Observers agree that in all likelihood, the Court’s majority will restore to states the right to make sane decisions on this subject.

Basically, what is going on here is that the Left wants to impose its concept of “gender identity” on the rest of us, whether we agree with it or not. (I don’t.) Not only that, they want to make it illegal to disagree with their recently cobbled-together rationale for discrimination against women and girls.

These cases are going to have the right result, but the fact that we even have to talk about this issue indicates how far both our culture and the legal profession have declined.
