
Little Missy Mogle might be alive today had her killer, a convicted pedophile named Daniel Spencer, been kept where he belonged: in jail. Instead, Spencer was out on bond pending sentencing for engaging in sex with a minor and, therefore, free to murder Missy, his five-year-old stepdaughter.
And now, the judge who released Spencer is facing calls for her impeachment.
In a letter last week to Florida House Speaker Daniel Perez, Florida Attorney General James Uthmeier called for Judge Tiffany Baker-Carper to face impeachment for allowing Spencer to bond out after his April 15, 2025, conviction for “traveling to engage in unlawful sexual conduct with a child.” One month later, wrote Uthmeier, “Spencer violently murdered 5-year-old Missy Mogle by hitting her, binding her feet and hands together, and covering her with pillows and comforters.”
“Judge Baker-Carper’s decision that allowed Spencer, a convicted child predator, to remain on bond is why Missy is dead today,” Uthmeier wrote. “This decision wasn’t just disgraceful, reckless, and unthinkable; it rises to the level of a ‘misdemeanor in office.’”
“Judge Baker-Carper’s actions brought disrepute upon the judiciary,” Uthmeier wrote. “But despite the obvious danger and warnings, Judge Baker-Carper let Spencer remain free, causing the untimely, violent murder of Missy.”
Florida law holds that “a judge is liable to impeachment for a misdemeanor in office, and the speaker of the House of Representatives can appoint a committee to investigate charges against any officer subject to impeachment.” And that’s the avenue Uthmeier is pursuing to have Baker-Carper removed from the bench.

The move by Uthmeier comes after Florida Governor Ron DeSantis signed “Missy’s Law” last Tuesday; the new law will require judges to revoke the bonds of individuals who have been convicted of violent crimes, including sex offenses.

DeSantis said of the decision to release Daniel Spencer back into the community after being convicted of a sex crime: “What happened in between that decision and the time he was sentenced, he murdered Missy. Totally preventable, a miscarriage of justice, a dereliction of judicial duty.”
In his letter to Speaker Perez, Uthmeier wrote of Missy’s Law:
“This legislation vastly improves Florida criminal procedure to prevent judged from putting social justice over criminal justice,” Uthmeier wrote. “But, the people of Florida demand accountability for judges—like the judge responsible for letting Missy’s killer remain free—who grossly abuse their discretion by inexplicably refusing to take custody of convicted child sex predators, allowing them to continue preying on our children.”
The details of what happened to Missy Mogle at the hands of her stepfather are horrifying. Detectives noted her body showed “excessive bruising” and other injuries that were “consistent with excessive punishment, likely caused by a belt or other instrument.” Missy’s mother, Chloe Spencer, has also been arrested, and now, alongside Spencer, faces charges of first-degree murder, aggravated child abuse, child neglect, and failure to report child abuse.
