The Trump administration must release Kilmar Abrego Garcia on his criminal charges in Tennessee, and immigration authorities must allow him to return to Maryland on supervision without taking him into custody, two judges separately ruled Wednesday.
As you may recall, I spend a significant portion of my life these days sitting in the back of federal district courtrooms in Minnesota, as immigration cases are heard. I am tracking 62 such cases, with the number growing each week.
As recently as this morning, I again heard a federal judge proclaim how they have no say, whatsoever, over what ICE can and cannot do.
Now we have two liberal (Obama) district judges conspiring to have a criminal felony defendant released, moved from Tennessee to Maryland, and ICE cannot touch him?
The Hill reports,
The rulings allow Immigration and Customs Enforcement (ICE) to restart Abrego Garcia’s immigration proceedings in Baltimore and try to detain him once he is back, but ICE must also provide 72 hours’ notice before removing him to a country where he has no ties.
Then what? Apparently, the whole thing has been delayed for another 30 days, to “figure out next steps.” For example, how is he to move from Nashville to Baltimore? Greyhound?
Meanwhile, I know less about federal immigration law than I did when I woke up, it sems.
