Biden-Appointed Judge Blocks Deportation of 8 Vicious Criminals to South Sudan – RedState

The fight to remove vicious illegal alien criminals from our country continues, and as should come as no surprise, a Biden-appointed judge is trying to block those efforts. There’s a lot to unpack in this case.





To begin at the beginning: On Tuesday, a federal district judge, Brian E. Murphy, ordered the Department of Homeland Security to maintain custody of any illegal aliens being deported to a third-party nation — that is, a nation that is neither the United States nor the home country of the persons in question. Of particular note were eight illegal aliens from Vietnam, Mexico, Cuba, Myanmar, and other places. All have been convicted of serious crimes and were to be deported to detention in South Sudan. Deportation flights for these illegals have, for the moment, halted.

You can view that order here. It appears to focus on the details of removal, how much notice each illegal was given, and whether they were able to appeal their removal. An additional hearing is being conducted Wednesday morning before Judge Murphy, as of this writing.

A Biden-appointed federal judge could decide Wednesday morning that a plane carrying illegal immigrants convicted of serious crimes to South Sudan has to return. 

The plane is carrying eight men – all of whom convicted of crimes ranging from homicide to robbery, according to details exclusively provided by the Department of Homeland Security. The DHS unveiled details of the crimes after U.S. District Judge Brian Murphy threatened to order the return of the migrants at a Wednesday hearing.

“No country on earth wanted to accept [the migrants] because their crimes are so uniquely monstrous and barbaric,” Assistant Secretary for Public Affairs Tricia McLaughlin said at a press conference Wednesday. “These heinous individuals have terrorized American streets for too long.”

“While we are fully compliant with the law and court orders, it is absurd for a district judge to try to dictate the foreign policy and national security of the United States of America,” McLaughlin said.

It’s unclear if South Sudan will be the final destination. DHS will sometimes remove aliens to third party countries if their home countries won’t cooperate with deportations. A Mexican being on this flight is a bit puzzling. A federal judge in Boston has ordered DHS to maintain custody of the men in case he rules that the flight is illegal/violated his court order.





This is where things stand: The illegal alien criminals in question, most notably the eight that were headed to South Sudan, will, for the time being, remain here in the United States.

Note that the eight men who are the specific subjects named here are not just illegal aliens. They have committed heinous crimes, far beyond just the fact of their illegal entry. These monsters have preyed on American citizens, and the Trump administration is correct to seek their removal, but in several of these cases, the criminals’ home nation won’t accept their return. South Sudan, granted, is an eyebrow-raising choice of destinations, but as of this writing, it’s unclear if that was the final destination for these criminals.

The Constitution gives the Executive branch broad powers over foreign relations and immigration. This isn’t the first time a judicial decision has attempted to interfere with those powers, and it’s not stretching a point to observe that this is a constitutional crisis in the making, especially when we note that no such objections were raised during the Obama administration, when millions of illegal aliens were deported.
