Senate Democrats have backed themselves into a corner in this shutdown business and are desperately seeking some exogenous event (deus ex machina) to justify a change of course.
Meanwhile, the U.S. Senate is set to confirm today the third federal appeals court judge since the shutdown began on October 1, with a fourth likely to follow later this week.
Since October 1, the Senate has confirmed seven district court judges.
