In a previous update on accused human smuggler Kilmar Abrego Garcia, the judge in his criminal case in Tennessee denied the government’s motion for pre-trial detention on grounds that he didn’t pose a serious flight risk.
Further, as RedState’s Susie Moore reported, U.S. Magistrate Judge Barbara Holmes concluded in her June 22 ruling that the government failed to prove there was a “serious risk” that Abrego Garcia would “obstruct justice or otherwise interfere with the integrity of this proceeding.” Subsequently, he was ordered released on Wednesday.
In May, the illegal immigrant and media-described “Maryland man” was indicted on two felony counts: conspiracy to transport aliens and unlawful transportation of undocumented aliens. He was brought back to the United States from El Salvador in early June to face those charges.

As of this writing, he remains behind bars. But in a new development in the Abrego Garcia saga, Justice Department attorneys informed the judge in his habeas/deportation case out of Maryland Thursday that the government intends to deport him to a “third country” – but didn’t provide a timeline:
Justice Department attorney Jonathan Guynn said the removal proceedings would be to a “third country.” But the prosecutor also said there are “no imminent plans” to deport Abrego Garcia and the U.S. government would comply with all court orders.
[The DOJ’s Jonathan] Guynn acknowledged the government’s plans during a hastily planned conference call with Abrego Garcia’s attorneys and U.S. District Judge Paula Xinis in Greenbelt, Maryland. Abrego Garcia’s lawyers had filed an emergency request for Xinis to order the government to take Abrego Garcia to Maryland when he is released in Tennessee, an arrangement that would prevent his deportation before he stands trial.

Though Abrego Garcia’s attorneys urged Judge Xinis to rule quickly on the matter, asserting their concerns that the government would try to begin deportation proceedings as soon as this weekend in the event he was released Friday, Xinis informed them that these things take time:
Xinis, however, said she could not move as quickly as Abrego Garcia’s attorneys would like. She said she had to consider the Trump administration’s pending motions to dismiss the case before she could rule on the emergency request. The judge scheduled a July 7 court hearing in Maryland to discuss the emergency request and other matters.
All of this being said, spokespeople for the Trump administration are claiming that reports of the government intending to deport Abrego Garcia, possibly before he stands trial, are “fake news”:
