Judge won’t rule this week on releasing Kilmar Abrego Garcia from jail.
Our man just can’t catch a break. And by limbo, I mean exactly that. I have seen no claim whatsoever that he is a legal resident of the United States. The claim rests on the idea that, despite his illegal status, he cannot be deported.

Lawyers for Kilmar Abrego Garcia tried to poke holes in the federal human smuggling case against him on Wednesday, while a federal judge won’t rule this week on releasing Abrego Garcia from jail, a decision that could ultimately lead to his deportation.
I’ve mentioned before that I’m following about 60 similar federal cases here in Minnesota. All involve illegal aliens charged with felonies in federal court. Each defendant is faced with more or less the same choice, stick around and go through weeks/months/years of due process in federal court, while in federal custody and then get deported. Or, short-circuit the process and then get deported.
To paraphrase the old Bugs Bunny gag, do you want to be deported now or deported later? Surprisingly, many simply cannot decide. The fate awaiting Abrego Garcia,
Lawyers for the Justice Department have said U.S. Immigration and Customs Enforcement will detain Abrego Garcia if he’s freed. ICE officials have said they will initiate deportation proceedings against him and will possibly try to send the construction worker who was living in Maryland to a third country such as Mexico or South Sudan.
Choose carefully.
