Pentagon Investigating Kelly: Good | Power Line

We wrote here about the disgraceful video produced by six elected Democrats, encouraging uniformed members of the military, as well as members of the intelligence community, to “resist” the Trump administration by refusing to obey orders. Today the Pentagon announced that it is investigating Senator Mark Kelly’s involvement in that incitement to insurrection:

As Secretary Hegseth said, Senator Kelly is subject to the Uniform Code of Military Justice. If appropriate, he could be recalled to active duty and courtmartialed. I assume that a number of cases have been decided under the UCMJ, that involve encouraging soldiers to disobey orders. I can imagine that such cases have not gone well for the defendants.

In their video, the six Democrats try to dodge responsibility by saying that service members should disobey “illegal orders.” But they plainly imply, and arguably assert outright, that the Trump administration is routinely issuing illegal orders that should be disobeyed, and is a threat to the Constitution. But as the Pentagon’s statement points out:

All servicemembers are reminded that they have a legal obligation under the UCMJ to obey lawful orders and that orders are presumed to be lawful. A servicemember’s personal philosophy does not justify or excuse the disobedience of an otherwise lawful order.

There are legal disputes over everything under the Sun. But has the Trump administration been issuing plainly illegal orders to military personnel? No. In fact, Senator Elissa Slotkin, one of those who appeared in the video inciting service members to rebellion, has specifically admitted that she is not aware of any illegal orders:

The Democrats are encouraging insurrection, plain and simple. They are so used to acting with impunity, and so convinced that all “resistance” to the Trump administration is virtuous, that they have gone over the line into outright sedition. Mark Kelly, as one still subject to military discipline, may learn this the hard way.
