Supreme smackdown | Power Line

U.S. District Court Judge Brian Murphy (MA) has been smacked down twice within a fortnight by the Supreme Court on the same case. That must be a record. From the Associated Press via the Detroit News,

The Supreme Court on Thursday cleared the way for the deportation of several immigrants who were put on a flight in May bound for South Sudan, a war-ravaged country where they have no ties.

This decision from the highest court yesterday got lost in the BBB passage euphoria (So much winning). On June 23, the Court, in a 6-3 ruling, had made the exact same decision. Judge Murphy chose to ignore his loss and pretended it didn’t happen with an aggressive use of the weasel word “notwithstanding.” Murphy’s defiance forced the Trump Administration back to court to enforce the earlier Supreme Court ruling. The latest smackdown was on a 7-2 vote.

Not that it matters, but,

The eight men sent to South Sudan in May had been convicted of crimes in the U.S. and had final orders of removal, Immigration and Customs Enforcement officials have said.

The News reports,

The court’s latest decision makes clear that the South Sudan flight can complete the trip, weeks after it was detoured to a naval base in Djibouti. There, the migrants who had previously been convicted of serious crimes were held in a converted shipping container.

It reverses findings from federal Judge Brian Murphy in Massachusetts, who said his order on those migrants still stands even after the high court lifted his broader decision.

I’m not a lawyer, I don’t know how any of this works. But shouldn’t Murphy be removed from the bench, disbarred even? The Court couldn’t have been clearer last month, and Murphy wasted 13 days and who knows how much taxpayer money with his personal narcissism.

By now the “migrants” will have reached South Sudan. I wish them all a Happy 4th of July, wherever they are!
