I take on the most critical question facing the United States today: for whose benefit is the nation being governed?
Who should it be? For my answer, I go back to the preamble to the U.S. Constitution, which begins with the famous three words, “We the People.” Why was “America” created? Why does America exist?
Who is included in “we”? Again, I fall back on the phrase,
secure the Blessings of Liberty to ourselves and our Posterity,
Who is included in “ourselves”? My answer would be current American citizens, “subject to the jurisdiction thereof.” It would not include noncitizens, not subject to the jurisdiction thereof.
In my views, “Posterity” would include the children and descendants, if any, of current citizens. Posterity would not include those foreigners (noncitizens) yet to be born, who may one day develop a desire to show up in America and enjoy the blessings.
Courts have found that illegal aliens, the instant they cross the border, are entitled to the full protection (blessings) of the Constitution including full due process, with limitless resources (court-appointed lawyers, translators, etc.) provided at taxpayer expense.
But none of the obligations of American citizenship is placed on new arrivals, only the taxpayer-funded benefits. They are not “subject to the jurisdiction.”
We’ve seen a similar revolution in corporate America. At one time it was widely understood that corporations were to be operated and run for the benefit of shareholders (owners) of the given enterprise.
Now we’ve developed the idea of “stakeholder capitalism,” where nonowners have someone acquired ownership rights over the assets and income of private companies, perhaps even a controlling interest.
The six million or so “undocumented” “unauthorized” “irregular” immigrants who arrived in the past four years did so with zero regard for America’s laws or customs.
Now that they are here, each of the six million or so will have their case considered individually, with full due process, and appeals, and further appeals.
To that end, from The Hill newspaper,
The Pentagon has approved the transfer of some of its military and civilian lawyers to the Justice Department to serve as temporary immigration judges, the Defense Department confirmed to The Hill on Tuesday.
It would appear that the “owners” of America in the sense of those who command its resources, are its most recent arrivals. And then those will be supplanted by the next group arriving tomorrow, and so on.
Call it, “stakeholder democracy.” Principles that function well at the retail level, begin to break down at a wholesale, industrial scale.
